Terms of Use

1. Agreement to these terms

These Terms of Use ("Terms") are a binding agreement between you and the operator of SoldSignal ("SoldSignal", "we", "us"). They apply to every way you access or use SoldSignal: the website at https://www.aiplannermail.com and its pages, the fee calculator, the weekly reports, the downloadable files, the JSON API, the Markdown and plain-text copies, embeds, and any other content or service we provide (together, the "Service").

By accessing or using the Service in any way, including through software, scripts, bots or AI systems acting for you, you confirm that you have read, understood and accepted these Terms and our Privacy Policy. If you do not agree, you must not use the Service. If you use the Service for a company or other organisation, you accept these Terms for it and confirm that you are authorised to do so.

You must be at least 18 years old, or the age of legal majority where you live, to use the Service.

2. Who operates SoldSignal

SoldSignal is an independent project operated by Malek Oweis, an individual based in Israel. Contact: malek_oweis@yahoo.com.

3. What the Service is, and what it is not

SoldSignal publishes aggregated statistics (medians, ranges, counts and fee calculations) computed from publicly available marketplace pages, for general information.

SoldSignal is not:

• a marketplace, store, broker, dealer, auction house or payment service. We do not sell, buy, hold, authenticate, ship or handle any item or money, and we are not a party to any transaction between you and anyone else;
• an appraiser, authenticator or valuation service. A price shown is not an appraisal, a certificate of value, a valuation for insurance, tax, customs, legal, estate or lending purposes, or a statement that any item is genuine;
• a provider of financial, investment, tax, accounting or legal advice. Nothing on the Service is a recommendation to buy, sell, hold or price any item, or an opinion that any item is a good investment;
• affiliated with, endorsed by or sponsored by any marketplace, brand or manufacturer named on the Service.

4. Prices, data and fee information

All prices, statistics, payouts, fee calculations, size and condition tables, weekly changes, insights and texts on the Service (the "Data") are estimates. In particular:

• The Data is collected from third-party websites that we do not control. Those websites can show wrong, partial, delayed, localised or changed information, and our collection, matching and calculations can make mistakes, for example by matching a different product, size, edition, condition or currency.
• "SOLD" figures describe past sales as reported by third parties. "ASK" figures describe asking prices, which are not sales. Neither is a promise that any item can be bought or sold at that price, now or later.
• Fee rules and payouts are simplified estimates based on public fee pages at the date shown. Marketplaces change fees, add charges (such as shipping, taxes, promotions, currency conversion or payment fees) and apply different rules by seller, country, category and account. The real amount you receive can be different.
• Data is updated about once a week and can be stale, missing or withdrawn. We have no obligation to update, correct or keep any Data available.
• Text on the Service is generated automatically from the numbers. It describes the Data; it is not a professional opinion.

You are solely responsible for checking prices, fees, authenticity and every other detail directly with the relevant marketplace or a qualified professional before you rely on the Data for any decision. Any decision you make using the Service is made at your own risk.

5. Open data licence

Unless stated otherwise, the Data in our downloadable files and API (for example under /data/ and /api/) is licensed under the Creative Commons Attribution 4.0 International licence (CC BY 4.0). You may share and adapt it, including commercially, if you give appropriate credit to "SoldSignal (https://www.aiplannermail.com)", link to the licence and indicate if you changed it. The disclaimers and limitation of liability in CC BY 4.0 and in these Terms both apply.

The licence covers the Data only. It does not cover the SoldSignal name and logo, the site design, images, illustrations or code, which remain ours (all rights reserved), and it does not grant any right in third-party trademarks. You must not suggest that SoldSignal or any marketplace endorses you or your use, and you must not present the Data as official data of any marketplace.

6. Acceptable use

You may use the Service, including automated access to the public pages, files and API, for lawful purposes. You agree that you will not:

• use the Service in breach of any law, or to mislead, defraud or harm anyone, including by presenting our estimates as guaranteed prices, appraisals or certificates of value;
• send requests at a volume or rate that degrades the Service for others (cache our files; they change about once a week), or try to probe, scan or test the vulnerability of our systems, or bypass any security measure;
• introduce malware, or interfere with or disrupt the Service or its hosting;
• remove or hide the attribution, licence notices or disclaimers that come with the Data;
• frame or copy the Service in a way that suggests it is your own, or use our name or logo without permission.

We may block, limit or stop any access at any time and for any reason, without notice.

7. AI systems, agents and third-party tools

AI systems, search engines and software agents may read, index, summarise and cite the Service, subject to these Terms and attribution under section 5. Answers, summaries, prices or advice that any third-party tool or AI system produces from our Data are that tool's output, not statements by SoldSignal. We are not responsible for how others select, change, combine, present or rely on the Data.

8. Third-party websites and trademarks

The Service links to third-party websites and names third-party marketplaces, brands, products and model numbers. These names are used only to identify the items and sources described (nominative use). All trademarks belong to their owners. We do not control and are not responsible for third-party websites, their content, availability, fees, policies or practices, or for any dealings you have with them.

9. Notices, corrections and takedown requests

If you believe something on the Service is inaccurate, infringes your rights or should be removed, email malek_oweis@yahoo.com with the page address, what you are asking for and why, and your contact details. We review every request in good faith and may correct, remove or keep content at our discretion. Sending a notice does not create any obligation or liability on our part.

10. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Service and all Data are provided "as is" and "as available", with all faults and without warranty of any kind, whether express, implied, statutory or otherwise. We expressly disclaim all warranties and conditions, including any warranty of accuracy, completeness, reliability, timeliness, merchantability, satisfactory quality, fitness for a particular purpose, title and non-infringement, and any warranty that the Service will be uninterrupted, secure, error-free or free of viruses or other harmful components, or that any error will be corrected. No advice or information obtained from the Service creates any warranty not expressly stated in these Terms.

11. Limitation of liability

To the maximum extent permitted by applicable law, SoldSignal, its operator and anyone acting for them will not be liable to you or to any third party for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, savings, business, opportunity, goodwill, data or value of any item, or for any loss arising from any purchase, sale, listing, pricing, trading, investment or other decision, or from reliance on any Data, in each case arising out of or relating to the Service or these Terms, however caused and on any theory of liability (contract, tort including negligence, statute or otherwise), even if we were told such damages were possible.

To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the claim (the Service is free, so normally zero) and (b) fifty US dollars (US$50).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, such as liability for fraud or wilful misconduct. Where the law does not allow a particular exclusion or limitation, that exclusion or limitation applies to the fullest extent the law does allow.

12. Indemnity

To the maximum extent permitted by applicable law, you agree to defend, indemnify and hold harmless SoldSignal and its operator from and against any claims, demands, losses, liabilities, damages, costs and expenses (including reasonable legal fees) brought by a third party or arising out of or relating to: (a) your use of the Service or the Data, including anything you publish, sell or decide based on it; (b) your breach of these Terms; or (c) your breach of any law or of any right of a third party.

13. Changes to the Service and these Terms

We may change, suspend or stop any part of the Service, including any Data, endpoint, file format or URL, at any time without notice or liability. We may update these Terms; the new version applies from the effective date shown at the top of this page. Your continued use of the Service after a change means you accept the updated Terms. If you do not agree, stop using the Service.

14. Governing law and jurisdiction

These Terms and any dispute or claim arising out of or relating to them or to the Service (including non-contractual disputes) are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Subject to any mandatory law that gives you the right to bring proceedings elsewhere, the competent courts in Tel Aviv-Jaffa, Israel have exclusive jurisdiction, and you consent to their jurisdiction.

15. Claims on an individual basis; time limit

To the maximum extent permitted by applicable law: (a) any claim must be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective or representative proceeding; and (b) any claim arising out of or relating to the Service or these Terms must be started within one (1) year after the cause of action arose, or it is permanently barred.

16. General

• Severability. If any provision of these Terms is held invalid, unlawful or unenforceable, it will be enforced to the maximum extent permissible (or modified to the minimum extent needed to make it enforceable), and the remaining provisions remain in full force and effect.
• No waiver. Not enforcing a right or provision is not a waiver of it.
• Entire agreement. These Terms, the Privacy Policy and any licence referenced here are the entire agreement between you and us about the Service and replace any prior understanding.
• Assignment. You may not transfer your rights or obligations under these Terms. We may transfer ours, for example if the Service changes owner.
• No relationship. Nothing in these Terms creates a partnership, agency, employment, fiduciary or advisory relationship.
• Language. These Terms are written in English. If they are translated, the English version prevails.
• Survival. Sections 4, 5, 7, 8 and 10 to 16 survive any end of your use of the Service.
